TERMS AND CONDITIONS OF SALE
The Customer shall pay the amount mentioned in the schedule by the due date. By accepting the goods or services provided you accept our terms and conditions of sale as laid out by Buy Trade Phones Ltd.
When a contract is in place in addition to the right of termination mentioned overleaf, Buy Trade Phones may terminate the agreement by giving 28 days notice if the customer has not paid the amount scheduled by the due date. Either party may terminate the agreement by giving 90 days notice if the other party has failed to perform any of its obligations under the agreement and such, failure continues for a period of 90 days after written notice thereof.
Buy Trade Phones may after the cost of the service for any year following the initial year give to the customer three months written notice.
When a contract is in place Buy Trade Phones undertakes during this Agreement to service the equipment in accordance with the terms and conditions of this agreement except when the repair is necessitated by: (a) a fault due to the customers error (b) the equipment being subject to abnormal physical or electrical stress (c) the equipment being damaged due to accident, neglect, misuse by the customer, acts of God, failure or fluctuation of electrical power or causes other than ordinary use (d) the equipment being tampered with by the customer or any other party. The above faults or damage, which are outside Buy Trade Phone’s service liability under the agreement, may be repaired by Buy Trade Phones at a price applicable at the time. The equipment may be replaced at the option of Buy Trade Phones for any length of time at Buy Trade Phone’s discretion with similar equipment, which will also be subject to the Terms and Conditions of this agreement.
The Customer will give or procure to be given to Buy Trade Phones or their servants or agents at all reasonable times, access to the premises on which the equipment is situated for the purposes of inspection, repair, adjustment or replacement.
Buy Trade Phones shall not be responsible to the Customer for any loss whatsoever arising out of any reason beyond the control of Buy Trade Phones which shall include, without prejudice to the generality of the foregoing any act of God, fire, flood, accident, strike lockout or stoppage of Buy Trade Phone’s business.
Buy Trade Phones may assign this agreement to any other person without serving any prior notice to the customer. The Customer cannot assign any rights arising out of this agreement.
The Customer must not allow any person apart from Buy Trade Phones, its employees or agents to service or in any way interfere with the equipment during the term of this agreement. Any maintenance by Buy Trade Phones necessitated by such service or interference shall be charged to the customer at the price applicable at the time.
Buy Trade Phones shall not be required to carry out servicing beyond its normal service boundaries.
In the event of a fault being reported to Buy Trade Phones, which is found to be a fault external to the equipment then Buy Trade Phones reserves the right to make a reasonable additional call-out charge.
This agreement shall form the whole of the terms of agreement between Buy Trade Phones and the Customer and no variation thereof shall be of any consequence whether prior to or subsequent to the date of the agreement unless expressed in writing and signed by or on behalf of Buy Trade Phones and the Customer.
This agreement and any conflict arising there from shall be governed by and judged by the Law of England.
All notices required to be give in writing shall be sent by first class post to the last known address of the Customer or Buy Trade Phone’s address as given overleaf. All such notices shall be deemed to have been served on the expiration 48 hours after posting.
Buy Trade Phones will not be responsible for personal injury to any person caused through the use of equipment supplied by Buy Trade Phones. Apart from this shall be under no liability for any injury, change or loss to any person or property whom so ever or whatsoever whether direct or consequential arising out of the use of the equipment howsoever such injury, damage or loss was caused. The Customer hereby agrees to indemnify Buy Trade Phones in respect of any liability for damage and/or costs incurred by any person whatsoever arising out of the use of the equipment.
All prices quoted are subject to VAT@17.5% and delivery charges from the manufacturer or supplier of the goods and services. All goods and services remain the property of Buy Trade Phones Ltd until the invoice has been paid in full including the VAT element. All quotations submitted are subject to change at any time due to the manufacturer or supplier of those goods and services making changes at short notice. Buy Trade Phones Ltd can not beheld responsible for any expense incurred by these changes as they are out of our control however we apologise in advance for any problems resulting from such changes.
It is our client’s responsibility to point out any problems they are experiencing with their equipment prior to our engineering visit. If we discover a problem with the system upon examination that we were not made aware of prior to our visit the client will be charged for any additional work resulting from this addition un-planned task. The appropriate Purchase Order paperwork will need to be signed and authorised by the client prior to any work being carried out by our engineers.
The invoice amount is payable immediately by the customer unless otherwise stated on the invoice by Buy Trade Phones Ltd Accounts department. These payment terms remain in force unless a special agreement is made between Buy Trade Phones Ltd and the customer. Buy Trade Phones Ltd reserve the right to charge interest for each day the invoice amount remains outstanding.
In the event of any reasonable despute between the Buy Trade Phones Ltd and the customer all Hardware products and at least 50% of the services fee must be paid for immediately by the customer. Buy Trade Phones Ltd have no intention of misleading the customer in any way therefore these payment terms are fair and must be adhered to.
Returns policy:
If you would like to return goods that you bought through this shop please call our customer care service within 7 days to get a return authorisation number on 0845 6582489 . Do not return goods without this authorisation .Any orders placed are subject to your rights of cancellation pursuant to the Consumer Protection (Distance Selling) Regulations 2000, except in respect of supply of audio or video recordings or computer software if you have unsealed their packaging.
You may exercice this right either by writing, e-mailing or telephoning or using facsimile transmission. In each case you must notify us within seven days from the date of delivery.
Following receipt of your notice we will contact you to arrange return of the goods. Please note that the cost of sending the goods back to us where you wish to cancel for reasons which are not due to product performance or description will be payable by you. P&P charges will not be refunded save for in circumstances where the goods are deemed to have been defective.
